Suspended


 

Suspensions are part of the job, as 92% of railroad employees will experience one at some point in their career. It is strongly recommended that members keep in contact with their Local Chairman throughout the process. Here's a list of things to consider when you are suspended from a railroad employer.

File a RRB Unemployment Claim

  • You can submit an unemployment claim online once you have established online access via a PRC (password request code) at www.rrb.gov.
  • If your base year is your first year of railroad service, you must have worked at least 5 months as well as met the earnings requirements.
  • Unemployment benefits are only for each day of unemployment in excess of 7, meaning there is a 7 day waiting period before benefits start being paid.
  • Normal benefits are paid for 130 days (26 weeks) and extended benefits payable for an additional 65 days with 10 or more years of service.
  • The maximum daily benefit rate payable in the benefit year beginning July 2013 is $68 and, for biweekly claims, maximum benefits can total $680. The daily benefit rate will increase to $70 in July 2014, and may increase in future benefit years depending on the growth in average national wages.
  • This can be a timely process, so we recommend you file your unemployment claim the same day you are notified of your dismissal.

File a Discipline Income Protection Claim

  • Claim form for SMART/UTU Discipline Income Protection Plan can be found here.
  • Claim form needs to be signed by both you and an Officer/Local Chairman of SMART.
  • For permanent dismissals, you will receive a new claim form every 2 weeks which requires the same signatures.
  • SMART/UTU Discipline Income Protection pays a maximum of 365 days. A schedule of benefits can be found here.

Union Pacific Members

  • Contact UPREHS at (800)547-0421 as soon as possible following a suspension or dismissal so that you will not have any interruptions in medical coverage.
  • Members on a suspension can receive a 6 month continuation of coverages for free. This does not apply to members that are dismissed by the carrier.
  • Members who are dismissed, (or suspended members who are past their 6 month free continuation of coverage), are eligible for 6 months of coverage at a cost of $100.00 per month.
  • An additional 6 months of coverage is available to members at the cost of $175.00 per month.
  • After exhausting 12 months of coverage (dismissed; 24 months if eligible for the free 6 month continuation, members may still purchase coverage for 6 months maximum at the cost of $702.37 per month.

BNSF Members

  • Contact United Healthcare at (800)842-9905 as soon as possible following a suspension or dismissal so that you will not have any interruptions in medical coverage.
  • Members on a suspension can receive a 6 month continuation of coverages for free. This does not apply to members that are dismissed by the carrier.
  • Members who are dismissed, (or suspended members who are past their 6 month free continuation of coverage), are eligible for 6 months of coverage at a cost of $ per month.
  • An additional 6 months of coverage is available to members at the cost of $ per month.
  • After exhausting 12 months of coverage (dismissed; 24 months if eligible for the free 6 month continuation, members may still purchase coverage for 6 months maximum at the cost of $ per month.

Union Pacific/BNSF Members

  • Contact United Healthcare at (800)842-9905 as soon as possible following a suspension or dismissal so that you will not have any interruptions in medical coverage.
  • If you are suspended or dismissed, and
    (1) you have had an employment relationship with your employer for at least six months, and
    (2) you have rendered compensated service for three months as an Eligible Employee,

    you will be covered for Employee and Dependents Health Care Benefits during your suspension or after your dismissal until the end of the fourth month following the month in which you last rendered compensated service.
  • Members may purchase an additional 14 months of coverage for their dependents at a cost of $702.37 per month and covers health, dental and vision.
